Fulbright & Jaworski L.L.P. partner Ted Daniel focuses his practice on business and construction litigation in both federal and state courts and arbitration proceedings. His litigation experience includes representation with respect to all aspects of construction projects, partnership disputes, shareholder control disputes, fiduciary breach claims, lender liability and other lender related claims, franchise disputes, real estate contracts, and deceptive trade practice claims.
With over 27 years of litigation experience, Ted has handled and tried numerous lawsuits and arbitration proceedings in almost all areas of business and construction litigation. A sample of recent and current matters for which Ted was or is the lead attorney include:
- in a three week jury trial, the state court defense of a $333 million claim for tortious interference and breach of contract in connection with a franchise arrangement;
- the representation of a general contractor in a six week arbitration hearing against the owner and subcontractor, and the subsequent representation of the contractor's surety and lender in related state and federal court litigation, arising out of a $115 million project for the construction of a new cement plant;
- the representation at a six day hearing on a lender's lift stay motion, and the defense of related state court fraud claims, in connection with a 1,000 acre piece of real property with a value of $40 million;
- the state court defense of a department of transportation against a contractor's $6 million claim for breach of two highway maintenance service contracts and fraud;
- in a two week arbitration, the defense of a department of transportation against a highway construction contractor's $4.5 million claim for design errors and breach of contract;
- the federal court defense of an owner against a general contractor's $5 million claim for impact, inefficiency and extra work costs in connection with the construction of a new tire plant; and
- the state court defense of a home builder against a developer's claim of breach of two lot take-down contracts valued at approximately $24 million per contract.
