EXPERIENCE

Scott Drake is a partner in the Dallas office of Fulbright & Jaworski L.L.P., where he has spent his career handling complex business disputes and litigation. His practice focuses on complex commercial litigation, with experience prosecuting and defending claims in commercial disputes, securities litigation, health care litigation and bankruptcy related litigation matters. Scott has represented national and international companies in a variety of industries, including the financial services and heath care industries. He represents a wide range of clients in state and federal courts throughout the country, with recent appearances in Texas, New York, California, Virginia, Indiana and Illinois.

REPRESENTATIVE EXPERIENCE

Some of the cases Scott has handled recently include the representation of:

  • a hospital development company in a favorable settlement of its suit to enforce contractual rights relating to ownership and governance of a limited liability partnership formed to develop a large scale physician owned hospital and medical office building complex
  • a closed end hedge fund in partial dismissal and favorable settlement of a securities class action involving allegations of securities fraud and GAAP violations
  • a financier of a going private transaction in defeating injunction claims in a series of shareholder class action cases which were later dismissed
  • a debtor in a multi-billion dollar bankruptcy in an adversary proceeding brought by the committee of unsecured creditors
  • a wire-line services company in the defense and favorable settlement of a $38 million CERCLA action
  • an international businessman in the successful challenge to personal jurisdiction in a multi-million dollar fraud and breach of contract case, which was upheld on appeal
  • a non-profit arm of a large teaching hospital in obtaining complete dismissal of multiple tort claims brought by a tenured professor
  • multiple large oil companies in obtaining partial summary judgment and favorable settlement of multi-plaintiff fraud and nuisance claims
  • an international distributor of consumer products in obtaining partial dismissal and favorable settlement of a multi-million dollar breach of contract and fraudulent transfer action brought by a former consultant
  • a data resource company in the favorable settlement of its counterclaims against one of the largest financial institutions in the country 
  • international reinsurers in the prosecution and achievement of the favorable settlement of a multi-million dollar computer fraud claim
  • a Medicare Advantage Plan in bringing a misappropriation of trade secrets and breach of contract case, which was favorably settled
  • a local municipality, as lead counsel, in over a dozen jury and bench trials
  • a large petroleum company in obtaining summary judgment in a breach of contract dispute
  • a children's hospital, as second chair, in an arbitration involving an insurance company's refusal to pay for medical care
  • a former NFL player in obtaining judgment, which was fully satisfied, in a breach of contract and fraud dispute
  • one of the world's leading manufacturer of personal electronics in successfully obtaining a summary judgment on a large promissory note

Scott was admitted to practice law in Texas in 2000 and is also admitted in the U.S. District Courts for the Northern, Eastern, Western, and Southern Districts of Texas and the U.S. Court of Appeals for the Fifth Circuit. He routinely practices throughout Texas in both federal and state court and has handled matters in numerous other courts throughout the country.

INTERESTS

Scott is an avid sports fan and enjoys playing basketball and golf. He also enjoys travel and reading in his free time.

Scott is a member of the 12th Man Foundation's Council of Athletic Ambassadors.
