AREAS OF CONCENTRATION
EXPERIENCE

Nitin Sud joined the Houston office of Fulbright & Jaworski L.L.P. in June 2010. As a senior associate, he works with Fulbright's Labor and Employment group. Prior to joining Fulbright, Nitin worked for several years with an international labor and employment law firm.  

Nitin frequently represents and counsels employers in all aspects of employment matters arising under both federal and state laws with respect to:

  • Discrimination laws (Title VII, ADEA, ADAAA) 
  • Fair Labor Standards Act (FLSA)
  • Family Medical Leave Act (FMLA)
  • Employment contracts
  • Unfair competition
  • ERISA

Nitin is board certified in Labor and Employment Law by the Texas Board of Legal Specialization. He has significant experience in both federal and state court pretrial and trial procedure, including oral hearings, trials, depositions, mediations, and TROs/temporary injunctions. Nitin also represents employers in responding to discrimination charges filed with the EEOC. Prior to law school, Nitin worked for two years as a policy analyst with the National Association of Public Hospitals in Washington, D.C.

REPRESENTATIVE EXPERIENCE
  • Served as second-chair in a federal court bench trial representing a chemical company in an ERISA class action case involving over 100 plaintiffs; the trial court ruled in favor of the chemical company on all claims
  • Served as second-chair in an arbitration defending a national transportation company in an FLSA class action; the arbitrator issued a total victory for the defendant 
  • Served as second-chair in a state court jury trial representing an oil services company in a Sabine Pilot wrongful termination case; not only did the jury find in favor of the defendant on the plaintiff's claim, but it also found the plaintiff liable for defaming the company
  • Represented a non-profit children's hospital in a contract and wage dispute with a former employee; court granted the summary judgment motion, dismissing five state-law claims
  • Received dismissal on summary judgment of an age and gender discrimination case for a medical devices company
  • Represented a former staffing company and individual partners in a wage and hour collective action dispute, resulting in a favorable settlement for the clients
  • Represented a retail chain in a wage and hour collective action dispute, resulting in a favorable settlement for the client
  • Assisted in conducting a nationwide wage and hour audit on behalf of a Fortune 500 engineering/construction company
