EXPERIENCE

Fulbright & Jaworski L.L.P. partner Marcus A. Torrano, heads the firm's California labor and employment practice, with over twenty years experience counseling and litigating on behalf of employers in all aspects of labor and employment law. Marcus defends companies accused of harassment, discrimination and wrongful discharge on the basis of gender, race and ethnicity, sexual orientation, age, disability and whistle-blower status, and has significant experience litigating disputes regarding alleged confidential trade secrets. Marcus also regularly represents employers in both individual and class action litigation involving alleged violations of California and federal wage and hour law.

Marcus serves as primary California employment counsel for many local, national, and international companies engaged in a variety of industries, including manufacturing, financial services, retail, transportation, healthcare, real estate development, forest products, energy and marketing, among others.

As part of his practice, Marcus regularly conducts in-house training seminars for California employers, including mandatory training for California employees regarding sexual harassment. Marcus also develops, reviews and implements personnel policies and employee handbooks for local, national and international companies of all sizes. Marcus also provides advice to clients regarding a broad array of labor and employment matters, including executive employment agreements, trade secret issues, wrongful discharge, discrimination, and harassment issues, federal and state wage and hour law, and California and federal laws implicated in corporate restructurings and reductions in force.

Marcus has tried cases successfully in both state and federal courts and has argued cases before the California Supreme Court, the California Court of Appeal, and the Ninth Circuit Court of Appeals. Marcus has also represented employers before the National Labor Relations Board, the Department of Fair Employment and Housing, the California Labor Commissioner and the California Unemployment Appeals Board.

REPRESENTATIVE EXPERIENCE
  • Successfully defended mortuary company against action alleging disability discrimination and failure to accommodate, obtaining a complete dismissal of the action on summary judgment. The case had been aggressively litigated by plaintiff's counsel, making the result that much more gratifying. Marcus continues to represent this client in ongoing class action litigation and general employment matters.
  • Represented and successfully negotiated a broad settlement agreement and release of wage and hour class action claims on behalf of an international forest products company. Although the Court initially certified only a limited class of employees, the settlement agreement resolved a much broader set of claims on behalf of an inclusive class and class period. As a result, the settlement agreement and release effectively precluded potential copycat litigation. Marcus continues to represent this client in ongoing employment matters.
  • Represented a national financial services company in a sexual harassment and retaliation case.  Marcus defeated all of plaintiff's claims on summary judgment, and is currently defending his client's victory on appeal before the California Court of Appeal.
  • Represented a national company in the healthcare industry in numerous class actions alleging violations of overtime, meal and rest period laws, and various other wage and hour claims. After extensive discovery and negotiations, Marcus was able to settle the cases on agreeable terms.  Marcus continues to represent this client in ongoing class action litigation and employment matters.
  • Represented an international nutritional supplement company in contract dispute with a former executive.  Plaintiff's claims were dismissed at arbitration, and Marcus recovered attorneys' fees for the client. Marcus continues to represent this client in ongoing litigation and employment matters.
