EXPERIENCE

Mary Beth Balhoff is an associate in Fulbright & Jaworski L.L.P.'s  Houston, Texas office. Mary Beth's practice focuses on complex commercial litigation, securities litigation, internal and government investigations and white collar crime. 

Mary Beth has worked extensively on internal investigations on behalf of audit committees and other board committees regarding a variety of issues involving United States trade sanction and embargo laws, federal securities disclosure requirements and U.S. anti-corruption and anti-bribery laws, including the Foreign Corrupt Practices Act (FCPA). Mary Beth's practice also includes representing companies and individuals before the Securities and Exchange Commission, the U.S. Department of Justice and other government agencies. 

Before joining the firm, Mary Beth served as a law clerk to the Honorable W. Eugene Davis, United States Court of Appeals for the Fifth Circuit.

REPRESENTATIVE EXPERIENCE
  • Development and implementation of anti-corruption policies and standard operating procedures
  • Anti-corruption and related regulatory due diligence review for acquisitions and third-party relationships
  • Representation of Special Committee of Board of Directors in internal review of options backdating practices
  • Representation of client in connection with SEC investigation of disclosure practices
  • Representation of client in $1 million seizure action initiated by Harris County District Attorney's office
  • Representation of client in successfully obtaining summary judgment for client in surface rights action
  • Representation of client in international investigation into dealings with sanctioned countries and alleged violations of U.S. anti-bribery and anti-corruption laws
  • Representation of Wall Street investment management firm defending against a putative class action alleging undisclosed amounts of markups and markdowns on bond transactions; after dismissing all but one of the plaintiffs' claims, Court denied class certification on remaining claim

PUBLICATIONS

During law school, Mary Beth authored "Corbello v. Iowa Production and the Implications of Restoration Damages in Louisiana: Drilling Holes in Deep Pockets for Thirty-Three Million Dollars," published in the 65 Louisiana Law Review 271 (Fall 2004). Mary Beth was a recipient of the Association Henri Capitant, Louisiana Chapter Award for best paper on a civil law topic or comparative law topic with an emphasis in the civil law for this comment, and was also awarded first place in the Fifteenth Annual Louisiana State Bar Association Environmental Law Essay Contest sponsored by the Association's Section on Environmental Law for an earlier draft of this comment. The comment was also cited in a concurring opinion by the Louisiana Supreme Court in M. J. Farms, Ltd. v. Exxon Mobile Corporation, 998 So. 2d 16 (La. 2008).
