Lee Haag has been a trial lawyer since 1974 and with Fulbright & Jaworski since 1989. Serving as co-head for the Construction Practice Group, he represents clients in the courtroom, in state and federal courthouses, where he concentrates his practice on construction disputes, energy and banking matters, as well as handling more general commercial disputes.
In construction litigation, Mr. Haag has handled cases involving virtually every aspect of the construction business, and has represented all sectors of the construction industry, from owners, contractors, and designers to material suppliers. Many of his cases are related to the energy, petrochemical and healthcare industry, but he also litigates and arbitrates disputes involving major commercial projects of all kinds. He has litigated disputes arising out of EPC contracts, Design-build and other forms of construction contracts.
Mr. Haag also represents clients in arbitrations and mediations.
In the area of banking and financial services, Mr. Haag has handled a wide variety of cases involving commercial lending, lender liability, and fiduciary obligations.
Most recent construction litigation matters:
- Refinery construction dispute – EPC contract; reactor vessel construction issues – procurement issues, scheduling, defective work, process design, replacement and repair damage issues, etc.
- Offshore production platform construction dispute regarding EPC contract: changes, delays, acceleration, liquidated damages, design issues, etc.
- Major hospital construction matters
- Power plant construction – EPC contracts; procurement issues, design issues, schedule and recovery effort issues, delays, changes, liquidated damages, etc.
- Mining construction – breach of contract and fraud relating to equipment specifications and performance criteria, loss profits, etc.
Other litigation matters:
- Trying and winning lender liability action arising out of bank's alleged breach of fiduciary duty in handling trust account and loan account
- Trying to jury and settling after trial delay damage case arising out of construction of commercial office building
- Trying to jury and winning victory on plaintiff's change order claim and prevailed on appeal of lower court's erroneous ruling relating to delay damage portion of case
- Leading patent team to significant favorable settlement in major patent litigation involving all television manufacturers relating to v-chip technology
- Trying to jury and successfully winning extra compensation in delay damage case on behalf of general contractor against municipality
- Handling and successfully completing lender liability case arising out of plaintiff/borrower claims of loan commitment violations relating to the purchase and construction of two hotel projects
- Handling major litigation on behalf of large real estate marketing/developer against owners of major residential and commercial subdivision
- Trying and successfully winning UCC breach of warranty and breach of contract matter

Lee was admitted to practice law in Texas in 1974. He regularly appears in various Texas state and federal courts and is admitted to practice in the United States District Court for the Southern, Northern, Eastern and Western Districts of Texas. He is also admitted to practice before the United States Supreme Court, the Fifth Circuit Court of Appeals and the United States Court of Appeals for the Federal Circuit.
Lee enjoys reading novels and historical books as well as playing the occasional game of golf.
