EXPERIENCE

Karl G. Dial, a partner in Fulbright & Jaworski L.L.P.'s Dallas office, practices in the firm's Litigation Section. He concentrates his practice in the area of complex commercial litigation, including cases involving director and officer liability, securities litigation, legal and accounting malpractice litigation, environmental litigation and information technology litigation.

Karl has extensive experience litigating in federal and state court and before arbitration panels, having tried dozens of cases in state and federal courts and before arbitrators with the National Association of Securities Dealers and the American Arbitration Association.

Karl has been a Certified Public Accountant since 1984 and has been Certified as a Civil Trial Specialist by the Texas Board of Legal Specialization since 1989. 

REPRESENTATIVE EXPERIENCE

His recent matters include:

  • Trial to a jury of breach of fiduciary duty claims by a minority interest owner against the management of two companies that sell all the prepaid products to several major retailers. The jury found that our clients fully complied with their fiduciary duties.
  • Representation of directors, officers and/or accountants in numerous class action securities cases.
  • Trial to a jury of an auditing malpractice case, which settled after a week of trial.
  • Trial to a jury of a case involving breach of a stock purchase agreement for a company that developed a GPS vehicle tracking system.
  • Trial to a jury of a case defending against claims of legal malpractice.
  • Representation of former officers and directors of companies who were sued by bankruptcy trustees.
  • Representation of a "Big 4" accounting firm in numerous malpractice lawsuits, including cases alleging audit malpractice which involved:
    • claims by hundreds of investors in several venture capital funds with damages alleged in excess of $100 million; and
    • claims by a failed retail business with damages alleged in excess of $30 million.
  • Trial of claims against a Brazilian investor in a complex case involving a breeding operation for imported Lusitano horses, a real estate development and partnership issues.
  • Trial of claims against an international electronics giant involving allegations of fraud and breaches of warranties in connection with goods purchased from a maquiladora plant in Mexico owned by the international electronics company.
  • Representation of a lender in a derivative case brought by the members of a rural electric cooperative in Alabama against the cooperative and its lender.
