Program
The federal government controls access rights to one half of all U.S. sovereign territory. In our second seminar, find out how the three agencies that manage most of that area operate with respect to wind energy projects on federal lands, both onshore and offshore. This primer includes details on how to gain and pay for access rights. Our program will cover:
The Law on Federal Lands
- The Interior Department's authority over offshore wind energy
- The split authorities of the Bureau of Land Management (BLM) and the U.S. Forest Service over onshore sites
- The major environmental statutes: National Environmental Policy Act, Endangered Species Act, Coastal Zone Management Act, Marine Mammal Protection Act
- Law governing contract and property interests on sites granted by the federal government
Administrative Mechanics of Site Acquisition and Project Development
- Projects on BLM lands
- Projects on Forest Service lands (including the national grasslands)
- Projects offshore: The emerging program of the Minerals Management Service
FERC's Role in Offshore Wind Projects
- Where FERC says it stands after the Energy Policy Act of 2005
- Point of contrast: FERC's role over ocean current and wave motion generators
