ACG v Olympic Airlines - Revisiting the Fundamentals of Risk Allocation in Airline Leasing

On 13th and 26th June 2012, Norton Rose and Fulbright & Jaworski L.L.P. will be hosting two events, the first in London, the second in New York, looking into the recent ACG v. Olympic case.
The recent judgment of the English Commercial Court in this litigation dealt with some fundamental issues of liability for lessors and airlines in delivery and redelivery situations. The case touched on the definition of airworthiness, potential recourse to a prior lessee for failure to meet return conditions, post delivery recourse to a lessor for failure to meet delivery conditions and potential recourse to the Maintenance Repair and Overhaul organisation (MRO) that performed the work. These factors can also have wider implications on such matters as insurance coverage and third party liability claims.
