F&J Wins Patent Infringement Case for Inforocket.com
On July 26, 2002, the New York office of Fulbright & Jaworski won a very favorable ruling for its client, Inforocket.com, Inc., sponsor of the popular LiveAdvice™ web site. District Judge Loretta A. Preska granted Inforocket.com’s summary judgment motion that it did not infringe the patent of its main competitor, Keen, Inc. This case was very important for Inforocket's ability to continue as a business entity.
The court resoundingly held that Inforocket did not infringe either literally or under the doctrine of equivalents. In finding no infringement under the doctrine of equivalents, the court applied the recently decided Supreme Court case of Festo Corp. v. Shoketsu Kinzoku Kogyo Kabushika Co., 122 S. Ct. 1831 (2002)
This case is unique in that it is one of the first cases decided by a district court to apply the newly issued Festo decision.
