EXPERIENCE

Jaclyn Hermes Caugherty joined the firm in 2003 and has worked in both the Austin and Houston locations. As a Senior Associate, Jaclyn's practice focuses on labor and employment matters. Jaclyn handles labor and employment litigation matters at both the trial and appellate level. She has represented management in civil rights actions (including race, gender, national origin, disability, age, equal pay, harassment and retaliation claims under Title VII, TCHRA, ADA, ADEA, and Section 1981), wrongful discharge, employment tort, defamation, breach of contract, tortious interference, Employee Retirement Income Security Act (ERISA), Family and Medical Leave Act (FMLA), Worker Adjustment and Retraining Notification Act (WARN) and other employment-related charges and litigation. She also regularly advises and defends clients in matters related to wage and hour law (FLSA), National Labor Relations Act (NLRA), Occupational Safety and Health Act (OSHA), Sarbanes-Oxley Act (SOX), the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank) and a variety of other labor issues. Finally, Jaclyn performs supervisory training seminars, prepares and reviews personnel handbooks and policies, drafts employment agreements, and regularly advises clients regarding employee discipline, leave, discharge, and retention issues.

Jaclyn is Board Certified in Labor & Employment Law by the Texas Board of Legal Specialization and is an active speaker and writer on labor and employment law issues. She has also been named a "Rising Star" in Labor & Employment Law by Texas Monthly in 2010, 2011, 2012, and 2013.  

REPRESENTATIVE EXPERIENCE
  • Recently secured a favorable ruling after oral arguments from the United States Court of Appeals for the Fifth Circuit, which affirmed summary judgment in a multi-plaintiff lawsuit that involved race discrimination, hostile work environment and retaliation
  • Secured a favorable ruling from the United States Court of Appeals for the Fifth Circuit, which affirmed summary judgment in an 11 plaintiff lawsuit that involved race, national origin and age discrimination, retaliation, hostile work environment and defamation
  • Secured a favorable ruling from the United States Court of Appeals for the Fifth Circuit, which affirmed summary judgment in a retaliation lawsuit
  • Secured a favorable ruling from the United States Court of Appeals for the Fifth Circuit, which affirmed summary judgment in a sex discrimination lawsuit
  • Served as second-chair for a hospital in a race discrimination failure to promote jury trial, which resulted in a defense verdict
  • Represented a college during a defamation jury trial, which resulted in a defense verdict
  • Represented a company during a multi-plaintiff, multi-week hostile work environment jury trial, which resulted in a favorable defense outcome
  • Obtained summary judgment for a company in a FLSA failure to pay overtime and retaliation dispute
  • Obtained summary judgment for a company in a multi-plaintiff race discrimination, sex discrimination, age discrimination, religious discrimination, hostile work environment and retaliation dispute
  • Obtained summary judgment for an assisted living facility in a quid pro quo sexual harassment dispute
  • Obtained summary judgment for a hospital in an ERISA denial of benefits dispute
  • Obtained summary judgment for an airline in a Sabine Pilot wrongful discharge dispute, which was upheld on appeal
  • Served as first-chair in over 15 jury trials for the City of Austin, which resulted in successful verdicts

After graduating Phi Beta Kappa, Jaclyn continued her Iowa education at the College of Law. During her tenure in law school, she served as an editor for the University of Iowa Writing Resource Center, where she edited the legal journal articles of professors and tutored law students on legal writing. She also won "Best Advocate" for the school's moot court competition and was selected as one of four third-year law students to present oral arguments to the full panel of the Iowa Supreme Court.   

Jaclyn is admitted to practice law in the State of Texas, in the United States Court of Appeals for the Fifth Circuit, and in the United States District Courts for the Northern, Southern, Eastern, and Western Districts of Texas. 

INTERESTS

Jaclyn enjoys traveling, spending time with friends and watching college sports. She is an avid fan of the Iowa Hawkeyes.
