EXPERIENCE

David Moroney is based in the London office of Fulbright & Jaworski International LLP. He has over 40 years experience in the structuring, negotiation and documentation of upstream and downstream oil and gas, electricity and mining projects and investments, and related acquisitions, disposals, financings and other transactions, and of the legislative, regulatory and investment regimes required for them, acting for both governments and investors.

His assignments have involved more than 60 countries in Africa, the Americas, Asia, the CIS, Europe and the Middle East, as well as Australia and the United Kingdom.

He has advised governments and agencies of both developed and emerging market countries.

He has been appointed as an arbitrator and as an Expert to resolve disputes.

In oil and gas, David's experience includes royalty and tax, production sharing, risk sharing and buy-back regimes; joint petroleum development areas; unitisation; offshore and onshore exploration and developments; processing, sales and transportation (including LNG, pipeline, gas, crude oil and product, shipping, offshore loading, cross-border and national pipelines, terminals and refineries); third party access; joint venture arrangements; tax; stability; project financing; corporate and asset acquisitions and disposals, farm-ins, farm-outs and the creation of overriding royalty and net profits interests agreements; decommissioning arrangements; dispute resolution; coal-bed methane and legislative and regulatory design.  

In electricity, his assignments have included IPPs, with extensive, pioneering experience in gas to power; power purchase and energy conversion agreements and contracts for differences; primary fuel purchase and transportation; third party access; shareholder and other joint venture arrangements; stability; project financing; corporate acquisitions and disposals; and industry and regulatory restructuring.

In mining, his assignments have included major government agreement based investments in new and existing gold, diamond, uranium and solar salt projects, including title, tax, stability, corporate, project financing and legislative and regulatory design issues.

David has lived and worked in Australia, the United Kingdom and Singapore, and his career has been equally divided between industry and private practice.  

He has extensive experience in lecturing and providing training to clients, colleagues and others. He runs an acclaimed series of 4 day masterclasses on oil and gas regulation, co-venture, field operation and other commercial contracting, financing, petroleum commercialisation and dispute resolution, including upstream licensing, production and risk sharing, and other petroleum titles, joint ventures, joint operating and unitisation agreements, field and other work services contracts, oil and gas sales and transportation, LNG and IPP projects, project financing, mergers and acquisitions, petroleum economics and international arbitration.  

He is a former director of the Association of International Petroleum Negotiators and co-chair of its committee charged with standardisation of its suite of model oil and gas agreements.

He is past chairman of the energy and natural resources section of the International Bar Association and an Honorary Life Member of the Association.
