Constitutional Law

Fulbright & Jaworski's Constitutional Law Practice Group litigates the difficult questions that arise when fundamental liberties are threatened and the limits of governmental power are at issue. We have tackled these issues in a number of contexts that reflect the breadth of our experience:
  • Challenging the constitutionality of local, state, and federal laws, facially or as applied. 
  • Defending local and state governments when violations of constitutional rights are alleged under Section 1983. 
  • Litigating regulatory "takings" claims. 
  • Defending free speech and First Amendment interests of media and non-media clients. 
  • Defending constitutional rights of suspects and defendants in white collar criminal cases. 
  • Appealing death penalty cases.

The results of these efforts are reflected in the following case law reporters:

  Morales v. Trans World Airlines, Inc., 504 U.S. 374 (1992) (Congress's enactment of the Airline Deregulation Act of 1978 operated under the Supremacy Clause to bar efforts by several states to regulate airline fare advertising).
  Vulcan Materials Co. v. City of Tehuancana, 238 F.3d 382 (5th Cir. 2001) (established federal jurisdiction over takings claims).
  Riley v. St. Luke's Episcopal Hospital, 196 F.3d 514 (5th Cir.) (declaring qui tam provision of the False Claims Act unconstitutional Under Article II), rehearing en banc granted, 196 F.3d 561 (5th Cir. 1999), reversed, 252 F.3d 749 2001 (5th Cir. 2001).
  Knox v. Collins, 928 F.2d 657 (5th Cir. 1991) (ordering new trial in death penalty case).
  Douthit v. Jones, 619 F.2d 527 (5th Cir. 1980) (addressing application of the qualified immunity doctrine in Section 1983 case).
  Retail Merchants Ass'n v. Handy Dan Hardware, 696 S.W.2d 44 (Tex. App.-Houston [1st Dist.] 1985, no writ) (appeal from trial court judgment declaring Texas Blue Law unconstitutional; appeal mooted when law was repealed).
